AFM Records GmbH: General Terms and Conditions

§1. General
These general terms and conditions apply to all business relationships between AFM Records GmbH and its customers. First of all we check if we are able to accomplish the order. Only then we will accept your order partly or entirely. Normally, this is done by delivering the goods. An order confirmation will be send to your e-mail address. The sales agreement between us is concluded by sending a confirmation or delivering the available goods.

§2. Price
All offers in our online shop are non-binding. All published prices on our website include value-added tax.

§3. Deliveries
We usually pack your order within 3-5 days upon entry of it. On top of that, it will take another couple of days to deliver the goods to your address, depending on country of delivery and custom regulations. Nevertheless it should not take more than 4-18 days for the postal service to deliver the package. The postal service we use will deliver it to your home or work address, if the attempt of delivery fails, your package will be taken to a near-by post office waiting there for approximately a week to be picked up. It is absolutely necessary to provide us with your telephone number or a valid e-mail address, so that we may contact you if there are problems with your order. Despite careful stocking it may happen that an article is sold out faster than expected, especially on bargain offers or limited editions. Therefore we do not give any guarantee of delivery. We are authorized to partial deliveries without previous agreement.

§4. Shipping and Handling
All prices in our online shop include value-added tax (19% for CDs and merchandise, 7% for books), but exclude shipping costs and fees for cash-on-delivery.

• Delivery weighs up to 2 kg or order value is less than EUR 50.00 = EUR 3.99
• Order value exceeds EUR 50.00 = EUR 0.00

• Delivery weighs up to 2 kg or order value is less than EUR 50.00 = EUR 3.99
• Order value exceeds EUR 50.00 = EUR 0.00

• Delivery weighs up to 2 kg or order value is less than EUR 50.00 = EUR 5.99
• Order value exceeds EUR 50.00 = EUR 2.00

* In addition to the shipping costs a fee will be charged by the deliverer (momentarily it is EUR 2.00)

All orders will be delivered by DHL / Deutsche Post. Transport damages will only be accepted by the deliverer when certified on delivery note.

NORWAY, SWITZERLAND AND REST OF THE WORLD:
until 0,5 kg = EUR 9,00 (1 - 4 CDs)
until 1,0 kg = EUR 14,00 (5 - 9 CDs)
until 2,0 kg = EUR 25,00 (10 - 19 CDs)
until 5,0 kg = EUR 40,00 (20+ CDs)

§5. Terms of Payment
If you decided to pay via PayPal or payment in advance (bank transfer or cheque), you are requested to pay right after submitting your order in our online shop. If you decided to pay by cash-on-delivery, the account will be settled by the deliverer at your front door / at the post office counter. Orders from outside Germany can only be paid via PayPal, Eurocheque or payment in advance.

§6. Free Articles
If your order value exceeds EUR 99.00, you will get a free gift of our choice.
If your order value exceeds EUR 133.00, you will get a free gift of your choice, which may be worth up to EUR 14.99.

§7. Reservation of Proprietary Rights
The property of the goods will remain with AFM Records GmbH until all accounts have been completely paid.

§8. Warranties
AFM Records GmbH is liable for the perfect technical and material conditions of the delivered goods. You can object delivered goods due to warrantable defects within the legally defined regulations. AFM Records GmbH is not liable for the suitability of the goods for a special intended use by the customer. We recommend inspecting delivered goods for defectiveness right after receipt.

§9. Right of Withdrawal
You can withdraw from the contract without giving reasons in writing (e. g. letter, fax, e-mail) within 2 weeks or – if you received the goods before the ending of the termination period – by reshipment of the delivered goods. This termination period shall commence upon receipt of this notification in writing, however not before you received the goods and not before we achieved our duty to inform according to § 312c paragraph 2 BGB in connection with § 1 paragraph 1.2 and 4 BGB-InfoVO. To meet the deadline, timely mailing or reshipment of the goods shall suffice. Withdrawal shall be sent to:

Cancellation Consequences
In case of a valid revocation of this agreement each party shall return to the respective other party the benefits received. If you can not return the goods or just in declined order and condition, you have to pay a compensation ( = money). Declined order and condition refers to e. g. used, washed or modified textiles or similar. This does not apply to declines, which solely result from an inspection of the goods. By the way, you can avoid the duty of compensation in refraining from anything that could diminish the value of the product or treating it as your own property. Packages may be reshipped at our risk. Goods that may not be shipped as packages will be picked up by us. You have to bear the expenses for reshipping if the goods match the order and if its value does not exceed EUR 40.00 or in the case of a higher value if you did not reciprocate or provide your reward as provided in the contract at the time of withdrawal. Otherwise we compensate the costs of reshipping. Payments have to be refunded by the customer within 30 days from dispatch of the notice of withdrawal or reshipping of the goods, by us within 30 days from its receipt.

Audio- / video recordings and software (e.g. CDs, LPs, DVDs…) are explicitly excluded from the right of withdrawal if you unsealed the delivered volume or removed its shrinkwrapping. Also journals, magazines and books are excluded from the right of withdrawal.

§10. Privacy Policy
According to the German Data Protection Act (BDSG) and Tele Services Data Protection Act (TDDSG) we solely save your personal data with the objective of being able to execute your order. Particularly, none of your personal data, apart from absolute necessary information for the distribution of you order, will be given to third persons. By request of a customer we will provide information about all personal data saved about her or him. At any time a customer can apply for modification or deletion of his personal data. Therefore please contact AFM Records GmbH.

§11. Registration
Ordering from AFM Records GmbH is very comfortable. We offer you a free registration and save your personal data in a password protected sales account, in order to avoid that you have to enter your name and address for your next order again. A sales account at AFM simplifies the order transaction and affords:

1. Articles are being saved in a shopping cart, thus you don’t have to re-enter your personal data when you come back.

2. You can change or delete your personal data at any time.

3. Registration is free and without any obligation.

At any time you can review or delete your personal data. This can be done after logging into your personal account. Please keep in mind that after deletion, your data will be completely deleted from our database and you have to register again in case of a new order.

§12. Cookies
Cookies are small pieces of data stored at your hard drive. Our cookies do not include personal data and solely conduce to navigation and recognition. Naturally, you can use our online shop as well without having your browser enabled to store cookies.

§13. E-Mail Newsletter
We offer you to subscribe to our free e-mail newsletter. After registration you receive an e-mail. To conclude your registration you have to click on the activation-link in this e-mail. Afterwards you will regularly receive information about new releases and specials. By clicking on the “Submit”-button you allow AFM Records GmbH, Agathe-Lasch-Weg 2, 22605 Hamburg, Germany, and its subsidiaries to use your mail-address for marketing purposes. This includes e. g. the consignment of e-mails with general information or advertises. Your mail-address will be saved permanently and in no case given to third parties.

If you do not want to receive our newsletter any longer you can unsubscribe from our mailing list at any time. Every mailing contains a link to easily unsubscribe. All data saved during the registration will be deleted.

§14. Severability
Should any part of this agreement be invalid for any reason, it is to be replaced with a corresponding text, which is valid and equivalent to the intended meaning. The rest of the agreement shall remain unaffected and valid. The same shall apply if the provisions of the contract are found to be incomplete.

§15. Place of Jurisdiction and Copyright
Place of jurisdiction shall be Hamburg, Germany. All contents of this website are subject to the copyright of the applicable copyright holder. Reprint, copies (even in extracts), linking and the like without our written approval is prohibited.
